Terms of Service

The terms that govern your use of MoonSleeper.

These Terms of Service ("Terms") govern your use of the MoonSleeper iOS application ("the App") provided by Lin Quote ("we", "our"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or 16 in the EU) to use MoonSleeper. By using the App you represent that you meet this requirement.

2. Your account

You may use MoonSleeper without signing up (anonymous mode). If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us at [email protected] if you suspect unauthorized access.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for non-commercial purposes on iOS devices you own or control, subject to these Terms and the Apple App Store Standard EULA.

You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App for unlawful purposes or to violate others' rights
  • Resell, sublicense, or redistribute the App or its content
  • Bypass payment, authentication, or rate-limiting mechanisms
  • Use automated means to scrape, copy, or extract data from the App

4. Subscription and billing (auto-renewal disclosure)

MoonSleeper Premium is offered as an auto-renewable subscription via the Apple App Store.

  • Monthly Premium: USD $4.99 per month
  • Annual Premium: USD $39.99 per year (save 33% vs monthly)
  • Free trial: New annual subscribers receive a 7-day free trial. Monthly subscribers do not receive a trial.

How auto-renewal works:

  • Payment will be charged to your Apple ID at confirmation of purchase, and at the start of each renewal period (monthly or annual).
  • Your subscription renews automatically at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • During a free trial, you can cancel at any time at least 24 hours before the trial ends to avoid being charged.
  • You can manage and cancel your subscription in iOS Settings → Apple ID → Subscriptions or in MoonSleeper → Me → Subscription.
  • Prices may vary by region and Apple may convert prices to your local currency.

Refunds are handled by Apple under the Apple Media Services Terms. We are unable to issue refunds directly. Request refunds at reportaproblem.apple.com.

5. Health information disclaimer

MoonSleeper is not a medical device. The App does not diagnose, treat, cure, or prevent any disease or condition, including sleep disorders. Sleep scores, snore detection, breathing analysis, and any related insights are for informational and self-improvement purposes only and are not a substitute for professional medical advice.

If you have concerns about sleep apnea, insomnia, or any other health condition, consult a qualified healthcare provider. Never disregard medical advice or delay seeking it because of information from MoonSleeper.

6. Audio recording

MoonSleeper requests microphone access to detect snoring and ambient noise during sleep tracking. Audio is processed on-device in real time and is not transmitted to our servers. Short snore clips may be stored locally for your review and may optionally be exported by you via the in-app debug export feature.

You are responsible for obtaining consent from any other person whose voice or sounds may be captured (for example, a partner sharing the room).

7. Content

The App includes audio content for sleep, meditation, and relaxation ("Content"). All Content is licensed to us by third parties or created by us, and is provided for your personal, non-commercial use only. You may not record, redistribute, or use the Content outside the App.

8. User-generated data

Sleep sessions, notes, ratings, and other data you create in the App ("Your Data") remain yours. You grant us a limited license to store, process, and display Your Data solely to provide the App's features.

9. Service changes and availability

We may update, suspend, or discontinue any part of the App at any time. We will give reasonable notice for material changes that affect paid features. We do not guarantee uninterrupted availability.

10. Termination

You may stop using the App at any time and delete your account. We may suspend or terminate your access if you violate these Terms or if required by law. On termination, paid subscription periods you have already been charged for will continue until the end of the period; auto-renewal is canceled.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be error-free, uninterrupted, accurate, or that Sleep Scores or insights are clinically meaningful.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL.

Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend and indemnify us from claims, damages, or expenses arising out of (a) your use of the App in violation of these Terms or applicable law, or (b) your violation of any third party's rights.

14. Apple-specific terms

You acknowledge that:

  • These Terms are between you and us, not Apple.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, who may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • We, not Apple, are responsible for any product warranty claims, claims that the App does not conform to legal requirements, and product liability claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated in the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of Taiwan, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Taipei, Taiwan, except where local consumer protection laws grant you the right to file a claim in your jurisdiction.
